Bombay High Court Orders Tax Refund to Vodafone Idea

In a significant ruling, the Bombay High Court has mandated the Indian Income Tax Department to issue a refund of Rs 1,128 crore to the telecom operator Vodafone Idea Limited VOD. The court found that tax authorities mishandled procedure, failing to adhere to the required timelines and processes as outlined by tax laws, resulting in this refund order. The decision also called for expedited corrective action, giving the department a strict deadline of 30 days to comply with the ruling.

The crux of the matter stems from Vodafone Idea's tax filings for the assessment year 2016-17. The Dispute Resolution Panel (DRP) had put forth an order on March 25, 2021, which became accessible on the same day through the Income Tax Business Application (ITBA) portal. However, instead of following the DRP's directive promptly, the assessing officer took an extensive period of nearly two years to issue the final order, which only surfaced in August 2023.

This delay in processing the refund drew ire from the High Court, which noted the assessing officer's protracted response resulted in a significant loss to the national exchequer. Such a delay could potentially warrant an inquiry into the assessing officer's actions, with the court advocating for stringent repercussions to prevent future occurrences of similar lapses.

Financial Implications and Market Reaction

The ruling was a boon for Vodafone Idea, with the company's shares noting a positive uptick of 1.4% at Rs 13.83, outpacing the otherwise flat Mumbai market. The judgment comes as a leeway for the telecommunications company, which has been beset by financial difficulties. Vodafone Idea argued that due to the inaction within the stipulated 30 days after the DRP's order was available, the income declared by them should be deemed accepted, therefore, entitling them to a refund.

On the other side, the IT department contended that the assessing officer only received the DRP's order in August 2023, coinciding with the introduction of the Faceless Assessment Regime. The department claimed that within a month following this, the officer acted accordingly. Nonetheless, the court found this argument insufficient to justify the prolonged delay.
